These Terms & Conditions apply to all golf cart, low-speed vehicle, neighborhood electric vehicle, and related equipment rentals provided by Family Local, LLC, a California limited liability company (“Company,” “we,” “us,” or “our”).
By reserving, paying for, using, operating, riding in, or accepting possession of the golf cart or related equipment, the renter agrees to these Terms & Conditions, the Rental Agreement, the Waiver and Release, all posted rules, and all written or verbal instructions provided by Family Local, LLC.
1. Rental is optional and separate from lodging
Golf cart rental is an optional service and is not included with any Airbnb, VRBO, short-term rental, lodging reservation, or property stay unless expressly stated in writing by Family Local, LLC. A lodging reservation does not guarantee golf cart availability.
2. Renter eligibility
To rent or operate the golf cart, the renter and each approved driver must:
- Be at least 25 years old, unless otherwise approved in writing by Family Local, LLC.
- Hold a valid driver’s license.
- Provide a copy of a valid driver’s license before the rental begins.
- Provide proof of current automobile insurance if requested.
- Complete identity verification if required.
- Sign all required rental documents, waivers, releases, and inspection forms.
- Be approved by Family Local, LLC before operating the cart.
Only approved drivers may operate the cart. The renter may not allow any unauthorized person, unlicensed person, minor, intoxicated person, or impaired person to operate the cart.
3. Vehicle use restrictions
The golf cart may only be used:
- In the approved local area designated by Family Local, LLC.
- On permitted public roads where operation is lawful.
- In a safe and prudent manner.
- With all passengers seated and using available seat belts.
- In compliance with all applicable laws, posted signs, traffic rules, and parking rules.
The golf cart may not be used:
- Under the influence of alcohol, cannabis, illegal drugs, controlled substances, impairing medication, or any substance that may affect driving.
- Off-road, on beaches, sand, trails, sidewalks, parks, lawns, curbs, or unapproved surfaces.
- On highways, freeways, roads with prohibited speed limits, or outside the approved geographic area.
- For racing, towing, pushing, jumping curbs, reckless driving, commercial use, rideshare, delivery, or transport for compensation.
- By any person who is not an approved driver.
- To carry more passengers than available seat belts or the posted maximum capacity.
- To transport hazardous materials, open alcohol containers, illegal substances, or unlawful items.
4. Safety rules
The renter is responsible for safe use of the cart at all times. The renter agrees to:
- Inspect the cart before use.
- Report any damage, defect, warning light, flat tire, unusual noise, brake issue, steering issue, battery issue, or safety concern immediately.
- Stop using the cart immediately if it appears unsafe.
- Keep both hands available for driving.
- Keep passengers seated while the cart is moving.
- Keep children supervised at all times.
- Secure personal belongings.
- Lock and secure the cart when not in use.
- Park only in lawful and safe areas.
- Return the cart clean, charged, undamaged, and on time.
5. Charging and battery
The renter is responsible for maintaining reasonable battery charge during the rental period and returning the cart with the required charge level stated in the reservation or rental instructions. The renter must monitor the battery level and may not allow the battery to drop below 50%. If the cart reaches 50% battery, the renter must stop recreational use and return directly to the approved parking/charging location. Battery depletion below 50%, failure to charge properly, or recovery due to low battery may result in additional charges.
The renter may not tamper with, remove, modify, damage, or misuse any charger, battery, electrical component, GPS device, lock, key, safety device, or accessory.
Loss, damage, misuse, or failure to return charging equipment may result in additional charges.
6. Inspections and photos
Family Local, LLC may require pre-rental and return inspections. The renter agrees that photos, videos, checklists, odometer readings, battery readings, GPS records, and inspection notes may be used to document the cart’s condition before, during, and after the rental.
Failure to complete a required inspection may result in cancellation, loss of deposit, or additional charges.
7. Security deposit and charges
Family Local, LLC may require a refundable security deposit, credit-card authorization, or other payment hold before releasing the cart.
The renter authorizes Family Local, LLC to charge the renter’s card or deduct from the deposit for amounts owed, including:
- Physical damage to the cart or equipment.
- Theft, loss, vandalism, missing equipment, lost keys, lost charger, or damaged accessories.
- Towing, recovery, impound, storage, or roadside assistance.
- Parking tickets, traffic citations, tolls, fines, penalties, and administrative charges.
- Cleaning fees.
- Late return fees.
- Battery depletion, improper charging, or recovery due to running out of charge.
- Unauthorized driver use.
- Unauthorized area use.
- Violation of rental rules.
- Any deductible, uninsured loss, or claim-related expense not paid by insurance.
The renter remains responsible for all amounts owed even if the deposit or card authorization is insufficient.
8. Cancellations, refunds, weather, and availability
Reservations are subject to availability, driver approval, completed documents, identity verification, payment, insurance requirements, inspection, weather, maintenance status, and safety review.
Family Local, LLC may cancel or refuse any rental if:
- The renter fails to meet eligibility requirements.
- The renter fails to complete documentation.
- The renter fails identity verification.
- The renter appears impaired or unsafe.
- The cart is unavailable due to maintenance, damage, theft, weather, safety issue, or prior renter misuse.
- Family Local, LLC determines that rental would create an unreasonable risk.
Refunds, credits, and cancellation fees are governed by the cancellation policy shown at checkout or stated in the rental agreement.
9. Accidents, damage, theft, tickets, and emergencies
The renter must immediately notify Family Local, LLC of any accident, collision, injury, property damage, theft, vandalism, traffic stop, citation, mechanical issue, battery issue, flat tire, or unsafe condition.
In an emergency, the renter must call 911 first.
The renter must not admit fault, abandon the cart, make unauthorized repairs, or continue operating the cart after an accident or safety issue.
The renter is responsible for obtaining police reports, witness information, insurance information, photos, and other documentation when applicable.
10. GPS tracking and geofencing
The cart may contain GPS, telematics, tracking, speed, location, battery, and usage-monitoring equipment.
By renting or using the cart, the renter consents to such monitoring for safety, recovery, billing, insurance, enforcement of rental rules, and protection of property.
Tampering with or disabling tracking equipment is prohibited and may result in additional charges, termination of the rental, and recovery action.
11. Assumption of risk
Renter understands that operating or riding in a golf cart, low-speed vehicle, or neighborhood electric vehicle involves risks, including collision, rollover, ejection, falls, equipment malfunction, weather conditions, road hazards, negligent drivers, pedestrian conflict, property damage, serious injury, or death.
Renter voluntarily assumes all risks associated with rental, operation, use, and riding in the cart, whether known or unknown, foreseeable or unforeseeable, except to the extent prohibited by law.
12. Release and indemnity
To the fullest extent permitted by California law, renter releases and agrees to indemnify Family Local, LLC, its members, managers, owners, employees, agents, affiliates, insurers, property owners, and representatives from claims, losses, liabilities, damages, fees, costs, and expenses arising from or related to the rental, operation, possession, use, misuse, parking, charging, towing, storage, or transportation of the cart.
This release does not apply to claims that cannot be released under California law.
13. Insurance, denied claims, and recovery rights
Family Local, LLC maintains commercial rental vehicle insurance for the cart, subject to all policy terms, conditions, limits, exclusions, deductibles, and claim requirements. The renter understands that insurance may not apply, or may be denied, if the cart is operated by an unauthorized driver, an unlicensed driver, a driver with a suspended or revoked license, an impaired driver, a driver who is not specifically listed as an approved driver, or in violation of these Terms & Conditions, the Rental Agreement, applicable law, or the approved-use rules.
Only drivers specifically listed in the Rental Agreement as approved drivers may operate the cart. Each approved driver must provide a valid driver’s license before the rental begins and must be approved by Family Local, LLC before operating the cart. The renter may not allow any other person to operate the cart. If the cart is operated by anyone who is not listed as an approved driver, the renter is fully responsible for all resulting damage, loss, injury, denied insurance claims, deductibles, charges, and legal consequences.
Nothing in these Terms & Conditions waives, releases, limits, or impairs any right of recovery, reimbursement, indemnity, or subrogation held by Family Local, LLC, its insurer, or any other party. Family Local, LLC does not waive any right to recover from the renter, approved drivers, unauthorized drivers, passengers, or third parties for damage, loss, deductibles, uninsured losses, denied claims, misuse, unauthorized use, or violation of these Terms & Conditions or the Rental Agreement.
14. No warranty
The cart is provided “as is” and “as available,” subject to required safety checks. Family Local, LLC makes no warranty that the cart will be uninterrupted, available for a specific event, suitable for a specific purpose, or free from inconvenience, delay, or interruption.
15. Governing law and venue
These Terms & Conditions are governed by California law. Any dispute shall be handled in the state or federal courts located in San Diego County, California, unless another forum is required by law.
16. Entire agreement
These Terms & Conditions, the Rental Agreement, Waiver and Release, reservation details, inspection documents, and written instructions form the entire agreement between the renter and Family Local, LLC regarding the cart rental.
